Welcome to Mind Arc Games. These Terms of Service ("Terms") explain the rules for using the Mind Arc Network, our websites, games, applications, online services, and related content, including Phoenix Vector: Assault.

By creating a Mind Arc Network account, playing one of our games, or using our services, you agree to these Terms. If you do not agree to them, please do not use our services.

Mind Arc Network Accounts

Some Mind Arc Games features require a Mind Arc Network account. A Mind Arc Network account gives you access to account-based features and online services provided by Mind Arc Games.

You are responsible for keeping your sign-in information secure. Please do not give your password or other account credentials to anyone else.

You are also responsible for activity performed through your account, except where applicable law provides otherwise.

Please provide accurate information when creating or updating your account.

You may not sell, transfer, or give your account to another person without permission from Mind Arc Games.

What Your Account Does Not Give You

Creating a Mind Arc Network account gives you permission to access and use the features we make available to that account. It does not give you an ownership interest in Mind Arc Games, the Mind Arc Network, our games, our software, or our services.

Scores, achievements, rankings, unlocks, cosmetics, virtual items, account status, and other game or account features do not represent shares, investments, ownership in Mind Arc Games, or a right to Mind Arc Games revenue or profits.

Eligibility

You must be legally allowed to use our services and create an account where you live.

If the law where you live requires permission from a parent or legal guardian, you must have that permission before using services that require it.

Playing Fair

We want Mind Arc Games services to be fair, secure, and enjoyable for everyone.

You may not:

• Cheat or intentionally exploit bugs or game mechanics.
• Use bots, unauthorized scripts, hacks, automation, or other software to gain an unfair advantage.
• Attempt to gain unauthorized access to another person's account, our servers, databases, or other systems.
• Disrupt, damage, attack, or interfere with our games or services.
• Impersonate another person.
• Use our services for fraud, abuse, or other unlawful activity.

Experimenting with a game, discovering a bug, or reporting a security problem in good faith is not the same thing as intentionally abusing one. If you discover a problem, we encourage you to tell us.

Our Games and Creative Work

Mind Arc Games owns, or has permission to use, the games, software, artwork, graphics, music, sound effects, logos, trademarks, code, text, characters, stories, worlds, and other creative material we provide.

Playing one of our games or creating an account does not transfer ownership of that material to you.

You may use our games and services for their intended personal use, subject to these Terms and applicable law.

Unless we give permission or the law gives you the right to do so, you may not copy, sell, redistribute, or commercially exploit our games, software, or other protected content.

Modifying and Examining Our Software

You may not modify, reverse engineer, bypass protections in, or create unauthorized versions of our software except where applicable law gives you a right to do so.

Nothing in these Terms is intended to take away rights that applicable law says cannot be restricted by an agreement like this one.

Things You Send Us

You keep whatever ownership rights you already have in original content that you submit to Mind Arc Games.

If you voluntarily send us feedback, suggestions, bug reports, screenshots, ideas, or similar material, you give Mind Arc Games permission to use that material to operate, develop, improve, promote, and support our games and services.

This permission is non-exclusive, worldwide, and royalty-free. This means you can still use your material, we can use it anywhere our services operate, and we do not owe a royalty simply because we use feedback or material you voluntarily submitted.

Please do not send us confidential information or material you do not have the right to share.

Virtual Items

Our games may include things such as cosmetics, achievements, unlocks, upgrades, virtual currency, or other digital items.

Unless we specifically say otherwise, virtual items are features of our games and services. They do not represent real-world property, an investment, or an ownership interest in Mind Arc Games.

Where permitted by law, virtual items are licensed for use within the applicable game or service rather than sold as property to the player. They have no guaranteed cash value and cannot be exchanged for real money unless Mind Arc Games provides an authorized way to do so.

Services Provided by Other Companies

Other companies help us provide parts of Mind Arc Games services. These may include account and database providers, website hosting, email delivery, payment services, analytics, and game distribution platforms.

When you use one of those services or platforms, its own terms and privacy policies may also apply.

Updates and Service Availability

Games and online services change over time. We may add, change, rebalance, replace, suspend, or remove features, content, game systems, or online services.

We work to keep our services available, but we cannot promise that every service will always be online or free from errors. Maintenance, technical problems, security issues, or events outside our control may interrupt a service.

We may also discontinue a game or online service when necessary.

Disclaimer

Our games and services are provided on an "as is" and "as available" basis. This means we cannot promise that every game or service will always be available, uninterrupted, error-free, or suitable for every particular purpose.

To the fullest extent permitted by law, Mind Arc Games disclaims warranties that would otherwise be implied by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by law, Mind Arc Games will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages resulting from your use of, or inability to use, our games, websites, or online services.

Some laws do not allow certain limitations or exclusions of liability. Where those laws apply, these limitations apply only to the extent the law allows.

Account Suspension and Termination

We may suspend, restrict, or terminate access to a Mind Arc Network account if the account is used to violate these Terms, compromise our systems, cheat, abuse other users, commit fraud, or seriously interfere with our games or services.

When appropriate, we may use a less serious restriction instead of permanently terminating an account.

Changes to These Terms

Mind Arc Games and our services will continue to develop, so these Terms may occasionally need to change.

When we update them, we will change the Last Updated date shown on this page. If a change requires additional notice or consent under applicable law, we will provide it.

Continuing to use our services after updated Terms take effect means you agree to the updated Terms, except where applicable law requires a different form of consent.

Governing Law

These Terms are governed by the laws of the State of Tennessee, United States, except where applicable law requires otherwise.
